  • Answer:

Firstly, let’s debunk a common misconception, a logo is not the brand, it is a part of the brand.

It begins with the business name and the concept of the whole enterprise.

The Brand encompasses the logo(s), colours, typography, layouts, audio, imagery from illustrations, iconography, photographs and videos. Your website is also part of your brand as is any marketing, printed media including car wraps, signage, merchandise and business stationery. Your Brand Identity also includes trademarks and patents.

Each of these elements, plus many more, represents the message of your business to your target market audience and this is called your BRAND IDENTITY.

So the answer is YES! Even if you are a small business, a brand identity is needed to communicate what you offer to your customers in order to help them solve their problem.

A brand will also make it easier to create advertising and marketing communications.

A BRAND IDENTITY will help you gain a competitive advantage in your niche market, as your competitors will most likely have a brand identity and people will remember them before you if they need to recall a company who can solve their problem, because a brand is easier to recall.

  • Answer:

A TRADEMARK is a symbol (Logo, design, illustration, icon), word, or words (business name, slogan, tag line, phrase) legally registered or established by use as representing a company or product.

A PATENT is a a government authority or licence conferring a right or title for a set period, especially the sole right to exclude others from making, using, or selling an invention.

  • Answer:

    It really depends…

Let’s say a company already owns a registered trademark or patent that you may want, it may actually cause problems for your brand(s) and/or product(s) should your business grow and evolve if you decided to use the trademarked/patented name or design.

It is highly recommended to hire a Brand Strategist before you decide on registering your business name.

This may require trademark services (a 3rd party) to do thorough research and investigations regarding the name(s) you are considering before you start naming your business, products and services identify any conflicts.

Not only can it impact your ability register website domain names, but it can cost you more money should a company dispute your use of the name(s) and take legal action.

    Example:

    • A Client hires Brand Specialist/Designer for a new consumer brand.

    • The Client had already registered the PTY LTD business name beforehand.

    • The Client advised the designer that they had already done the online searches for business names similar or the same and they didn’t find any conflicts.

    • The project commenced to create the brand identity, full business suite, website, product packaging, the works.

    • More then three-quarters into the project, the Client received a cease and desist letter from a company with an almost identical name, business concept, products and was also in the same state and region. This was devastating to the Client.

    • The Client had to register a new business name.

    • The Designer had to recreate a new brand identity, including a new logo using the new name and adjusting all artwork and website with the new logo.

    • The Designer ended up having to be paid twice due to this oversight because the Client did not do their research thoroughly enough and didn’t look where Brand Strategists are skilled at investigating, prior to hiring the designer.

This is why it is important to check this before you register your business name, naming your business should be part of your strategic business plan and your branding specialist should be involved along the way to ensure this doesn’t happen.

It was a very expensive and avoidable mistake by The Client and it could have been much less if the Client had hired the right people for the job first. It cost them more in the end.
