In ordering professional coaching, ground and aerial photography & videography media, RePL Instruction and coaching, Keynote Speaking or other consultancy services with “Heather James” using this online site or connected and related sites, in person, verbally or in writing, you agree to be legally bound by these Terms and Conditions. Please read these terms carefully.
If you do not accept these Terms and Conditions stated here without modification, you may not use the services provided by Heather James and/or Professional Drone Imagery Pty Ltd. Heather James “heatherjames.com.au” is a Creative Professional, Photographer & Videographer, Aerial Media Specialist and RePL Instructor/Coach as well as an Internet entity “heatherjames.com.au” of which clients can view and order services to be produced for their company in a way that is easier for the them and the client from the comfort of their own home or workplace.
“Heather James” communicates with clients through online communication platforms, online chat, messenger services, social media, WhatsApp, email, landline phone, video conferencing, mobile/smartphone, email and in person.
“Heather James” does not visit clients or meet with clients in person unless the order for a client meeting has been processed and prepaid as part of an approved and accepted project invoice which is sent from Heather James’s company Professional Drone Imagery Pty Ltd.

By engaging the services of Heather James, you confirm that you:
Are 18 years of age or older
Understand that Heather James is a GST-registered business via her company Professional Drone Imagery Pty Ltd
Accept that GST is charged on all services and will be included in your invoice
Agree to these terms and conditions in full
Commit to completing the booking process and signing a service agreement where applicable
Quotes and Payment Terms
All quotes must be reviewed and approved via the online payment system QuickBooks, which will then be converted to an invoice for payment.
For imaging and photography services: 50% deposit required to secure the booking, with 50% balance due before receiving final deliverables.
For aerial photography and videography: Additional fees and charges may apply for specific locations. This can occur when the scope of the project changes or differs from the original brief. You must understand and agree to this possibility prior to booking with me.
Heather James reserves the right to decline services to clients who do not meet these eligibility requirements or who are not a good fit for the working relationship.

Deposits and Payment
Heather James offers three different payment methods depending on the service:
1. Coaching and Tutoring Services (via Superprof)
Full payment is required upfront at the time of booking through Superprof. Your first session is free (30 minutes) and is added to your first fully paid booking.
Standard rates:
1 hour session: $147 AUD
5 hour package: $735 AUD
10 hour package: $1,470 AUD
In-person sessions include a $100 travel fee
You can also discuss being invoiced directly instead of using Superprof.
2. Photography, Videography, Aerial Imaging, and Creative Services
A quote will be provided by Professional Drone Imagery Pty Ltd via QuickBooks. A 50% deposit is required to begin work, with the 50% balance due before final deliverables are provided.
For larger or more complex projects, staged payments or retainer payment arrangements can be discussed and negotiated at the time of booking.
All invoices must be paid within 14 days. Unpaid orders may be cancelled or rejected if reordered.
Late Payment Fee: If an invoice is not paid by the due date, a late fee of $50 AUD per day applies.
3. Remote Pilot Licence (RePL) Instruction
You will pay iDroneTrain directly for all RePL Instruction courses. Payment in full is required prior to commencing online training with me.
Your payment to iDroneTrain covers:
The CASA-accredited course
CASA licence application processing and fees
20 hours of online training with me
Practical training and assessment with me
Heather James receives commission from iDroneTrain for online training delivery and is paid hourly for in-person practical training and assessment.
REOC and AROC Certifications
REOC (Remote Operated Aircraft Operators Certificate) and AROC (Aeronautical Radio Operators Certificate) are separate certifications. These are processed through iDroneTrain and their CASA-accredited third-party service providers.
You will pay iDroneTrain directly for these courses. Heather James will coordinate your connection with the third-party providers, who will conduct the training and assessment via their online systems. Heather James receives commission from iDroneTrain for these referrals.

Project Brief
Applicable to all photography, aerial imaging, coaching, and RePL instruction services.
Submitting Your Project Brief
It is your responsibility to send a detailed project brief to Heather James. This includes relevant information, specific requirements, images or references, and detailed descriptions of what you need.
A project brief is required for any project to commence. The project brief forms the basis of your service order and initiates the quote and proposal with costs and expenses outlined.
A deposit payment is also required as outlined in the Deposits and Payment section.
Right to Decline or Terminate
I reserve the right to decline a project or terminate an ongoing project if the deposit has not been paid or if invoiced installments are not paid as agreed. If this applies to your project, I will notify you.
Your Contact Person
Upon ordering my services, please nominate a contact person to communicate with me throughout the project. It works best if this contact person remains consistent.
If you change your contact person, please introduce them to the project scope and provide their updated contact information via email.
Working Together
For services to be delivered effectively and on time, I need your cooperation and clear communication. A strong working relationship relies on both of us being professional and respectful.
If there are concerns about how the project is progressing, I'm happy to discuss them openly. If communication or cooperation becomes difficult, we can discuss whether the engagement is a good fit and explore next steps together.
Information and Changes
Please provide all required information at the start of the project rather than partway through.
Changes to the original brief may incur additional costs depending on the project type, scope, and stage of completion. I'll communicate clearly about any changes and fees involved.

Photography and Aerial Imaging Services
Revisions relate to photo and video editing changes. The number of included revisions and how they work are negotiated and agreed upon before work begins.
Included Revisions
You receive 2 minor edits for changes you request. These are included in your project cost.
If I make an error, miss something, or there's a typo, that's on me to fix before final delivery and doesn't count toward your 2 revisions.
Additional Revisions
Once you've used your 2 included revisions and want more changes, additional revisions are charged at $147 AUD per hour. I'll send you a separate invoice for any revisions beyond the 2 included.
Reshoots
A reshoot at my expense only happens if I've made a mistake or haven't followed your brief correctly.
If you change your mind about the original scope and want a reshoot, that's a new project and will be quoted and invoiced separately.
Consultancy and Additional Services
If you want consultancy for marketing advice, sales lead generation, social media management and setup, or general advice, these fall outside the original project scope and will be quoted and invoiced separately.
Coaching and RePL Instruction
No revision policy applies to professional coaching services or RePL Licence Training Course instruction.

To the fullest extent permitted by law, “Heather James” and “Professional Drone Imagery Pty Ltd” will not be held liable or responsible for:
Any loss of profit, financial loss, or business impact resulting from the services provided
Any loss of data, revenue, or business opportunity
Any indirect, consequential, or special damages arising from the services
The use, misuse, or outcomes of the final deliverables after they have been provided to you
Any decisions or actions you take based on the services or advice provided
Your Responsibility
Once a project has been finalised and delivered, all responsibility for how it is used, implemented, or distributed lies with you.
If you choose not to follow my professional recommendations or suggestions, “Heather James” and “Professional Drone Imagery Pty Ltd” cannot be held liable for the end result of the project or any outcomes arising from that decision.

I aim to deliver projects on or before the agreed turnaround date whenever possible.
Agreed Turnaround Times
Turnaround times are specified for each service or package and are discussed, negotiated, and agreed in writing before any payment is secured. This forms part of your service agreement.
What Affects Turnaround
The initial turnaround time I provide is based on my production schedule. However, the full project completion time also depends on how quickly you respond to requests for feedback, approvals, and revisions.
Delays and Notification
If a project takes longer than agreed, I will notify you of the delay and provide an approximate new completion date. This can happen if I receive a high volume of orders at once or if additional information or approvals from you are needed.
When Turnaround Begins
Turnaround time is calculated from the day I send you the production confirmation after I've received:
Your completed project brief
Full payment
Any additional information or images needed to begin work

Your Ownership
The copyright of all finalised photography and aerial imagery produced for you belongs to you. You own the final deliverables.
My Use Rights
I retain the right to:
Display your final images in my portfolio
Use them on my website and social media (Facebook, Instagram, LinkedIn, Twitter, YouTube, Pinterest, TikTok)
Feature them on trusted portfolio sites such as Behance
Use them in printed marketing materials (brochures, flyers, advertisements, signage)
Use them to promote and market my services
This helps me showcase my work to potential clients.
Exclusive Licensing
If you pay a premium for full exclusive licence use of the content, I will not use the images in my marketing, portfolio, or social media, and the content will not be available for others to purchase.
Exclusive licensing must be explicitly stated and agreed upon in writing before any payment is made or work commences on the project. If exclusivity is not mentioned in your written agreement and payment does not reflect an exclusive licence fee, I reserve the right to use the images in my online content and marketing.
Heather James and Professional Drone Imagery Pty Ltd will not be held liable or responsible for your failure to secure exclusive licensing in writing prior to project commencement.
I reserve the right to refuse exclusive licensing or any services at any time for any reason.
Unused Work
Any draft images, concepts, or work that is not finalised and delivered to you belongs to me. These materials may be deleted or destroyed during file management processes.
Your Responsibility
You are responsible for ensuring that you have the legal right to use the final images for your intended purpose. If there are any trademark, copyright, or legal issues related to how you use the images, that is your responsibility, not mine.

Coaching Services (via Superprof)

Photography and Aerial Media Services (via Professional Drone Imagery Pty Ltd)
All projects are specifically tailored to your needs. If you require a specific type of project package, contact me to discuss your requirements, budget, and desired outcomes. I can work with you to create a package that fits.
I also offer monthly, quarterly, and yearly retainer packages for ongoing photography and aerial media needs.
Remote Pilot Licence (RePL) Training (via Professional Drone Imagery Pty Ltd and iDrone Train)
All pricing and packages are set by iDroneTrain, our CASA-accredited training partner. Packages and current pricing will be provided as a quote from iDroneTrain at the time of your enquiry, as prices may change over time.

Remotely Piloted Aircraft Operator Certification (REOC)
Aeronautical Radio Operators Certification (AROC)
Additional Qualifications
If you also need a White Card to legally and safely access construction sites for your drone imaging work, I can connect you with that service to ensure you have all the qualifications you need to run your drone business.
For full transparency: I may or may not receive commission, bonus, or payment for referrals to third-party service providers.

Coaching Services (via Superprof)
When you purchase your first fully paid coaching lesson via Superprof, you receive a complimentary 30-minute session added to your booking.
Pricing Policy
Heather James and Professional Drone Imagery Pty Ltd do not offer discounts, special offers, or reduced rates. Prices are set as negotiated and tailored to your needs and budget.
Remote Pilot Licence Training
I am paid by iDroneTrain for students I refer to them from NSW. I deliver 20 hours of live online training and 10 hours of practical training and assessment for Remote Pilot Licence courses, for which I am paid hourly by iDroneTrain plus travel expenses.
Because iDroneTrain sets all pricing and packages, I am unable to offer discounts or special offers on these services. Pricing is determined by iDroneTrain, not by me.
For full transparency: I receive commission from iDroneTrain for referrals from NSW.
Not-for-Profit and Charitable Work
As a small, family-run business, I do not offer professional services or reduced pricing to not-for-profit organisations, charities, or social enterprises. I do not have the capacity to take on this type of work.
Payment Required
All professional services require payment. I do not provide services in exchange for exposure, social media promotion, or other non-monetary arrangements, regardless of the influencer status or profile of the person requesting.
All services are paid via invoice and cash transactions only.

Your Responsibility
If you provide me with logos, images, video content, or any branded materials to include in your photography or aerial imaging project, you are responsible for ensuring you have explicit written permission from the original creator or brand owner to use that content.
This includes:
Company logos or trademarks
Third-party images or video
Branded products or signage
Any copyrighted or trademarked material
If you do not have written permission to use this content, do not provide it to me for inclusion in your project.
Third-Party Content in Your Images
If your photography or aerial images inadvertently include third-party logos, brands, trademarked products, or copyrighted material (such as signage, branded vehicles, or other company property), you are responsible for ensuring you have the right to use these images for your intended purpose.
iDroneTrain and Training Partners
iDroneTrain and their CASA-accredited third-party service providers have agreed to the use of their branding and content for the purposes of training paid students and marketing activities to inform prospective students about available certifications and training options.

iDroneTrain Partnership - iDroneTrain is our CASA-accredited training partner. They hold CASA accreditation for Remote Pilot Licence training courses and assessment materials, which are co-branded with Professional Drone Imagery Pty Ltd. I deliver online and practical training for students referred through this partnership.
Other partnership opportunities in complementary areas (such as solar and electrical services, real estate, construction, or marketing) are welcome. Contact me to discuss potential collaboration.
Proposals
Proposals are provided by Professional Drone Imagery Pty Ltd following your initial project brief. A proposal outlines service options, scope, timeline, and investment for your specific project.
Receiving a proposal means you are approximately 90% ready to move forward. The next phase includes finalizing details, signing a contract, and establishing payment and project management processes.

Heather James reserves the right to revise the terms and conditions on this page at any time. Changes will be posted on this website and will become effective 30 days after posting.
Your continued use of this website and booking of services after the 30-day notice period constitutes your agreement to the revised terms and conditions.
If you do not agree with any revision, you have the option to cancel any pending services or projects before the new terms take effect.
For existing projects or ongoing services, the terms and conditions in effect at the time of your booking will apply unless otherwise agreed in writing.

This Agreement shall be governed by the laws of Australia and the state of New South Wales. Any disputes arising from this Agreement will be subject to the jurisdiction of the courts of New South Wales.
